1.1Aligator Technology LLC, QFC License No. 03195, based in Doha, Qatar and licensed by the Qatar Financial Centre and Media City Qatar ("Aligator", "we", "us" or "our"), owns and operates a media monitoring platform. The platform collects and analyses publicly available news, online and social media content and delivers search, alerts and reports to its customers. It is made available as a website and web application (each, the "Platform").
1.2These terms and conditions (the "Terms") form a legally binding agreement between Aligator and the business that uses the Platform (the "Customer", "you" or "your"). They govern your access to and use of the Platform and the Services. Please read them carefully, as they contain important information about your rights, remedies and obligations.
1.3By accessing or using the Platform, you agree to these Terms and to our Privacy Policy. If you do not accept any part of them, you must not use the Platform.
1.4By accepting these Terms, you represent and warrant that:
- the individual accepting these Terms is at least eighteen (18) years old and is authorised to bind the Customer;
- the Customer is duly registered and licensed to carry on its business in the State of Qatar;
- you are legally capable of entering into a binding agreement; and
- you are not barred or otherwise prohibited from using the Platform under the laws of the State of Qatar.
1.5These Terms apply together with the SaaS Agreement. If there is any conflict between these Terms and the SaaS Agreement, the SaaS Agreement prevails.

3. Scope of the Platform
3.1The Platform lets organisations monitor publicly available media in Arabic and English. It provides the following Services:
- Monitoring: collection of Monitored Media that matches the keywords, topics and sources you set up;
- AI analysis: detection of topics, sentiment, relevance and entities, translation and summarisation, grouping of mentions into themes, and estimates of the country or area a post or public author relates to;
- Alerts: notifications by email and, if you enable it, WhatsApp; and
- Search, reports and dashboards: tools to search, report on and share Monitored Media and Outputs.
3.2Aligator provides a technology service only. You decide what to monitor, why, and how to use the Outputs.
4. Third-Party Sources and Third-Party Providers
4.1Third-Party Sources. Monitored Media is created and published by third parties. Aligator does not create, endorse or verify it, and does not guarantee its accuracy, completeness, lawfulness or continued availability. Sources may become unavailable if their APIs, licences or terms change.
4.2Public content only. Aligator collects Monitored Media through official platform APIs, licensed data providers and its own web crawlers. It does not collect private messages, closed groups or content behind a login it is not authorised to use.
4.3Rights in Monitored Media. Monitored Media may be protected by the intellectual property rights of its authors or publishers. You may use it only within the Services for your internal business purposes, subject to those rights and to Applicable Law.
4.4Third-Party Providers and sign-in. Aligator uses the Third-Party Providers listed in the Privacy Policy to deliver the Services. If you use a third-party sign-in option, such as Sign in with Microsoft, that provider's terms also apply. The Platform may link to third-party websites; including a link is not an endorsement, and Aligator is not liable for any loss arising from your dealings with any third party.
4.5Requests from named individuals. Individuals named in Monitored Media may ask Aligator to review, restrict or remove content about them, as described in the Privacy Policy. Where justified, Aligator may restrict or remove that content from the Platform, including from your Outputs. Aligator cannot remove content from the original publisher.
5. Eligibility and use requirements
5.1Territory. The Platform is intended for businesses operating in the State of Qatar. To register, you must be established in Qatar and have a Qatari mobile number. You must not use the Platform outside the State of Qatar except as agreed in writing with Aligator.
5.2Devices and connectivity. You need a compatible device and an internet connection that meet the system requirements Aligator publishes from time to time. You are responsible for these, and for any fees charged by your device or telecommunications provider. Aligator is not responsible for any security lapse or service failure caused by your device, internet provider or failure to follow our installation instructions or minimum system requirements.
5.3Updates. You may need to install updates to keep using the Platform. Aligator is not liable for any damage you could have avoided by installing an update we offered you free of charge.
6. Accounts and security
6.1Account activation. You need an Aligator account to use the Platform. An authorised representative of Aligator will activate your account once you have signed the SaaS Agreement and provided all required supporting documents. Your use of the account is subject to these Terms and the Privacy Policy.
6.2Information we need. During registration or afterwards, we may ask for your users' names, work emails, phone numbers (including a WhatsApp number if you choose WhatsApp alerts), job titles and organisation, together with your billing details and company registration documents. We may ask for further documents to verify this information, and may refuse or suspend access if we cannot verify it or if you are not eligible to use the Platform. Our use of this information is described in the Privacy Policy.
6.3Accuracy. You are responsible for the accuracy and completeness of all information you give us, and must keep it up to date.
6.4Users and credentials. You are responsible for everyone who accesses the Platform through your account, and for keeping all login credentials confidential. All actions taken and instructions given through your account are treated as made by you.
6.5Unauthorised use. You must follow any security measures Aligator recommends. If you believe your account has been accessed or used without authorisation, notify us immediately at info@aligator.ai. You are responsible for any activity on your account that occurs before you notify us.
6.6Account closure. Aligator is not responsible for loss of data or other damage resulting from your closure of your account or its later restoration.
7. Fees
7.1Fees for the Services, and any applicable usage limits, are set out in the SaaS Agreement.
7.2Aligator may change its fees in accordance with the SaaS Agreement.
8. Acceptable use
8.1You may use the Platform only for your own legitimate business purposes, in good faith, and in accordance with these Terms, the SaaS Agreement and Applicable Law.
8.2You must not:
- use the Platform for any unlawful purpose;
- set up monitoring without a lawful reason under the Data Protection Legislation and other Applicable Law;
- use the Platform or Outputs to stalk, harass, intimidate or unlawfully profile or track any individual;
- use Outputs as the sole basis for decisions that have legal or similarly significant effects on an individual;
- copy, republish or distribute Monitored Media in breach of the rights of its authors or publishers or of Applicable Law;
- copy, modify, reverse engineer, decompile or attempt to extract the source code of the Platform, or scrape or bulk-extract data from it, except as permitted by Applicable Law;
- resell, sublicense or otherwise make the Platform available to any third party;
- interfere with or disrupt the Platform, its security or the data of other customers; or
- upload or transmit any virus or other harmful code.
8.3Operational limits. We may set general practices and limits on use of the Platform. Subject to the SaaS Agreement, we may change, suspend or discontinue any feature, or restrict access to any part of the Platform, and will give you reasonable notice where practicable.
8.4Breach of this Section 8 may result in suspension or termination of your access under Section 17.
9. Data and privacy
9.1Ownership. You own your Customer Data. You grant Aligator a non-exclusive, royalty-free licence to host, copy, process and transmit Customer Data to provide, secure and improve the Services, as described in the Privacy Policy.
9.2Roles. As described in the Privacy Policy, Aligator acts as controller for the personal data of your account holders and users. Aligator acts as processor for the Monitored Media you instruct it to monitor and the reports built from it, and processes that data on your instructions.
9.3Your responsibilities. You decide what to monitor and why. You are responsible for having a lawful reason under the Data Protection Legislation for your monitoring setup and your use of Outputs, and for any notices or consents that requires.
9.4Personal data breach. If a breach affecting your Customer Data is likely to cause serious harm, Aligator will notify you without undue delay, as described in the Privacy Policy, and will give you reasonable assistance in meeting your obligations under the Data Protection Legislation.
9.5Testing and aggregated data. Aligator may use Monitored Media to test and evaluate the quality of its analysis. Aligator does not use Customer Data in testing unless it has been anonymised or you have agreed. Aligator may use anonymised and aggregated data, which does not identify you or any individual, to operate and improve the Services.
9.6Retention. Aligator keeps data for the periods set out in the Privacy Policy. Your monitoring setup is kept for 30 days after your account ends, during which you may request an export of it. Your account and contact details are kept for 12 months after your account ends. Monitored Media is not deleted unless a valid request is made under the Privacy Policy.
9.7Shared links. You can share reports and dashboards through publicly accessible links, and anyone with a link can view its content. You are responsible for the links you create and for who you share them with.
9.8International transfers. Aligator hosts the Platform on Amazon Web Services in the United States, and some Third-Party Providers process data in other countries, mainly the United States and the European Union. You acknowledge that Customer Data will be transferred outside the State of Qatar. Aligator makes such transfers only where permitted by the Data Protection Legislation and with contractual and technical safeguards, as described in the Privacy Policy.
9.9Privacy Policy. Our collection and use of personal data, and the rights of individuals in relation to it, are described in the Privacy Policy.
10. Communications and feedback
10.1Service communications. You consent to Aligator contacting you by email, SMS or other means, directly or through third parties, to provide the Services (including alerts by email and, if you enable it, WhatsApp), send account, billing and payment information, and investigate or resolve complaints and other service issues.
10.2Marketing communications. With your consent, we may also send you information about our Platform, new products and activities, and offers from our Affiliates or partners, as well as surveys about your experience and needs. You can withdraw this consent at any time by using the unsubscribe option in the message or by contacting info@aligator.ai, without affecting your use of the Services.
10.3Feedback. If you submit comments, ideas or suggestions about the Platform, you agree that they are given voluntarily and without restriction, do not place Aligator under any confidentiality or other obligation, and may be used and disclosed by Aligator without compensation to you.
11. Intellectual property
11.1The Platform and its contents are protected by copyright, trademark, patent, trade secret and other intellectual property laws of the State of Qatar and internationally. Aligator and its licensors own all title and intellectual property rights in the Platform and its contents, other than Customer Data.
11.2Subject to these Terms and the SaaS Agreement, Aligator grants you a limited, non-exclusive, non-transferable, revocable licence to use the Platform for your internal business purposes during the term of the SaaS Agreement.
11.3These Terms do not transfer any intellectual property rights to you. You must not use Aligator's or its Affiliates' names, logos or other intellectual property without our prior written consent.
11.4You grant Aligator a licence to use your organisation's name, logos and monitoring setup solely to provide the Services, including sending your keywords to the data and AI providers listed in the Privacy Policy to run searches and analysis. You confirm that you have the rights needed to grant this licence.
12. Disclaimers
12.1To the fullest extent permitted by Applicable Law, the Platform and the Services, including all content, software, functions and information made available through them, are provided "as is" and "as available". Aligator, its Affiliates and their agents, co-branders and partners (the "Aligator Parties") make no representation or warranty of any kind, and disclaim all warranties, including warranties of merchantability, fitness for a particular purpose and non-infringement.
12.2Aligator does not warrant that the Platform will be uninterrupted, error-free or completely secure, and is not responsible for service interruptions, including system failures and power outages.
12.3Monitored Media is third-party content, and Outputs are generated automatically, partly by AI. Aligator does not warrant that Monitored Media or Outputs are accurate, complete or up to date, and Outputs are not legal, financial or other professional advice. Aligator is not responsible for any decision you make based on Monitored Media or Outputs.
12.4Nothing in these Terms or the SaaS Agreement creates a partnership, joint venture or agency between you and Aligator.
13. Limitation of liability
13.1To the fullest extent permitted by Applicable Law, no Aligator Party is liable to you or any third party for any indirect, consequential, special, punitive or exemplary damages, or for any loss of profits, revenue, goodwill, use, data or other intangible losses, however caused and even if advised of the possibility of such loss.
13.2The total cumulative liability of the Aligator Parties arising out of or relating to these Terms, the SaaS Agreement or the Services, whether in contract, negligence or otherwise, will not exceed the fees you actually paid to Aligator in the [three (3)] months immediately before the event giving rise to the claim.
13.3Nothing in these Terms excludes or limits liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation; or
- any other liability that cannot be excluded or limited under Applicable Law.
13.4Each party acknowledges that the limitations in this Section 13 are an essential basis of the bargain between the parties.
14. Force majeure
No Aligator Party is liable for any failure or delay caused by events beyond its reasonable control. These include government action, acts of terrorism, earthquake, fire, flood or other natural events, pandemics, strikes and other labour disputes, lockouts, curfews, power failures, internet disturbances, and outages or changes affecting Third-Party Sources or Third-Party Providers.
15. Indemnity
You agree to indemnify, defend and hold harmless Aligator, its Affiliates and their directors, officers, employees, agents, licensors and contractors (the "Indemnified Parties") from and against all claims, demands, liabilities, losses, costs and expenses, including reasonable legal fees, arising out of or relating to:
- your use of the Platform;
- your breach of these Terms, the SaaS Agreement or any other applicable policy;
- your monitoring setup, your use of Outputs, or any content you share through report or dashboard links;
- your negligence or your violation or alleged violation of Applicable Law; or
- your violation or alleged violation of the rights of any third party, including through Customer Data.
16. Release and third-party disputes
16.1To the extent permitted by Applicable Law, you release the Indemnified Parties from all claims, demands and damages arising out of or connected with any dispute between you and any Third-Party Source, Third-Party Provider, individual named in Monitored Media or other third party.
16.2You agree not to involve Aligator in any litigation or other dispute arising from any transaction, agreement or arrangement between you and such a third party. If you do, you will pay all costs and legal fees Aligator and its Affiliates incur as a result, and Section 20 will apply to the proceedings.
16.3Nothing in these Terms waives any rights, claims or defences you have under Applicable Law that cannot be waived.
17. Suspension and termination
17.1Aligator may suspend or terminate your access to the Platform immediately, without liability to you, if:
- you breach these Terms or the SaaS Agreement;
- you fail to pay fees when due;
- we reasonably suspect fraud, unlawful use or a security risk; or
- we are required to do so by Applicable Law or a competent authority.
17.2Either party may otherwise terminate in accordance with the SaaS Agreement. Aligator may also close accounts that have been inactive for [twelve (12)] months after giving you notice.
17.3On termination, your right to use the Platform ends immediately, and Section 9.6 applies to your Customer Data.
18. AI and automated analysis
18.1The Platform uses language models and analytics from the AI providers listed in the Privacy Policy to classify, translate and summarise Monitored Media and to produce other Outputs.
18.2Aligator does not use this analysis to make decisions that have legal or similarly significant effects on an individual.
18.3Aligator does not use Customer Data or Monitored Media to train its own AI models. It sends content to AI providers through their business APIs, whose terms do not allow them to use that content to train their models.
18.4AI Outputs can be imperfect. You should review Outputs before acting on them.
19. Changes to the Terms and the Services
19.1Aligator may amend these Terms from time to time. We will post the updated Terms on the Platform and update the "Last updated" date. For material changes, we will notify you by email or through the Platform at least fourteen (14) days before they take effect.
19.2Changes apply from their effective date. If you continue to use the Platform after that date, you accept the updated Terms. If you do not agree, your remedy is to stop using the Platform and terminate in accordance with the SaaS Agreement.
19.3Subject to the SaaS Agreement, Aligator may modify or discontinue the Services, in whole or in part, temporarily or permanently. Aligator is not liable to you or any third party for any such modification, suspension or discontinuation.
20. Governing law and jurisdiction
20.1These Terms are governed by and construed in accordance with the laws of the State of Qatar.
20.2The competent courts of the State of Qatar have exclusive jurisdiction over any dispute arising out of or relating to these Terms, and you irrevocably submit to their jurisdiction.
20.3Aligator may disclose information you provided on the Platform where required to comply with Applicable Law, legal process or an enforceable request from a government authority.
21. General provisions
21.1Assignment. You may not assign or transfer these Terms or any rights under them without Aligator's prior written consent. Aligator may assign or transfer its rights and obligations under these Terms, in whole or in part.
21.2Confidentiality. Each party may receive confidential information from the other in connection with the SaaS Agreement or these Terms. Each party will keep the other's confidential information confidential and use it only to perform the SaaS Agreement and these Terms. This obligation does not apply to information that is or becomes public through no fault of the receiving party, was lawfully known to it beforehand, or must be disclosed by law or a competent authority.
21.3Waiver. A failure or delay in exercising any right or remedy is not a waiver of it, and a single or partial exercise does not prevent its further exercise.
21.4Survival. Provisions that by their nature are intended to survive termination will survive, including Sections 9, 11, 12, 13, 15, 16, 20 and 21.
21.5Severability. If any provision is found invalid or unenforceable, it will apply with the minimum deletion needed to make it valid, and the remaining provisions will stay in full force. Any provision held ineffective will be replaced by a valid provision that comes closest to its original intent.
21.6Entire agreement. These Terms, the SaaS Agreement and the Privacy Policy form the entire agreement between you and Aligator regarding the Platform.
